Terms and Conditions

1. IDENTIFICATION AND DEFINITIONS

1.1. Service operator

The Service is operated by:

In these Terms Gurin Dmitrii IE is referred to as the “Operator”.

1.2. Business

A restaurant, café or other establishment that has entered into a contract with the Operator and uses the Service to run its own loyalty Programme.

1.3. User

A natural person who registers on the Service and takes part in Businesses' Programmes.

1.4. Rewards

Stamps, points, vouchers, discounts, status tiers, gifts and other benefits of the Programmes.

2. PURPOSE OF THESE TERMS

2.1. These Terms govern the User's registration and use of the Service, as well as participation in Businesses' Programmes.

2.2. The specific terms of each Programme (number of stamps required, discount percentage, rules for accruing and using points, validity of Rewards) are set exclusively by the relevant Business.

2.3. The Operator is not a party to the sales contract between the User and the Business (food, drinks, services, discounts, gifts).

3. REGISTRATION AND ACCEPTANCE OF THE TERMS

3.1. To use the Service, the User completes the registration form, confirms their contact details and ticks the box “I accept the Terms and the Privacy Policy”. The box is not pre-ticked.

3.2. Consent is recorded in an electronic form that allows the fact of it being given to be verified afterwards: the date, time and version of the document.

3.3. The User undertakes to provide truthful and up-to-date data.

3.4. Each natural person may hold only one account.

4. ROLES OF THE OPERATOR AND THE BUSINESSES

4.1. The Operator ensures the technical operation of the Service and maintains the record of Rewards on the basis of the data provided by the Businesses.

4.2. Each Business independently sets the terms of its Programme and is responsible towards the User for delivering the benefits promised in its Programme.

4.3. Complaints regarding the quality of a Business's goods and services, performance of the Programme terms, customer service, prices or the menu must be addressed directly to the relevant Business.

5. REWARDS

5.1. Rewards are not electronic money, currency, legal tender or a bank deposit and, unless the Programme terms provide otherwise, are not exchangeable for cash.

5.2. Rewards accrue when the actions set out in the Programme terms are carried out. The accrual rules are set by the Business and displayed in the Service.

5.3. To use Rewards, the User is identified through the Service (QR code, phone number or another method). Rewards may only be used at the relevant Business.

5.4. Where the validity of Rewards is limited, it is determined by the Business and stated in the Service. Once the period has elapsed, Rewards cease to be valid.

6. USE OF THE SERVICE

6.1. The User undertakes not to give their credentials to third parties, not to use the Service for unlawful purposes, not to interfere with its technical operation and not to falsify data relating to transactions, receipts, visits, stamps or Rewards.

6.2. In the event of a breach of these Terms, the Operator may temporarily suspend or block the account and cancel Rewards obtained fraudulently.

7. COMMUNICATIONS AND NOTIFICATIONS

7.1. The Operator may send notifications necessary for the operation of the Service: registration confirmation, account security, accrual or expiry of Rewards, changes to the Terms. These notifications cannot be opted out of while the account is active.

7.2. Commercial messages (email, SMS, push) are sent only with the User's separate consent, which may be withdrawn at any time — through the account settings, the link in the email, or by contacting the Operator.

7.3. When the User adds a card to Apple Wallet or Google Wallet, the device's operating system may display system notifications on its own. These are generated by the device, are not personalised commercial messages from the Operator, and are configured in the device settings.

8. PERSONAL DATA

The processing of personal data is governed by the Privacy Policy and by the Law of the Republic of Armenia on the Protection of Personal Data.

9. THE OPERATOR'S LIABILITY

9.1. The Operator bears liability as established by the law of the Republic of Armenia. These Terms do not limit the consumer rights provided for by law, and the Operator's liability is neither excluded nor limited below the minimum established by law.

9.2. The Operator is not liable for the acts or omissions of the Businesses, including changes to their Programme terms, refusal to grant a discount or gift, and the quality of their goods and services.

10. DURATION AND TERMINATION

10.1. These Terms apply from the moment the User accepts them, for as long as the account is active.

10.2. The User may stop using the Service at any time and request deletion of their account.

10.3. If the Service is discontinued, the Operator gives Users reasonable prior notice.

11. GOVERNING LAW AND DISPUTES

11.1. These Terms are governed by the law of the Republic of Armenia, including the Law on the Protection of Consumer Rights.

11.2. Disputes are resolved through negotiation and, failing agreement, by the competent court of the Republic of Armenia.

12. AMENDMENTS TO THE TERMS

The Operator may amend these Terms. The current version is always available in the Service, stating the date of the last update. The User is separately notified of significant changes. If the User does not agree with the changes, they must stop using the Service.
